Determing On The Subject Of Liability In Traffic Accidents

With the increase of automobile quantity,traffic accidents are dramaticly increasing every year .In most traffic compensation disputes ,the determining on the subject of liability is of the first importance.It directly affects the victim's compensation. So far, this question has not been thoroughly discussed in the academic circle. The current provisions on the subject of liability in the Tort Law of China are too general .And there are still some problems to be solved. Therefore, it is of necessity to study the subject of liability.This paper firstly comments on the related traffic legislations in China in order to identify the problems existed and then refers to foreign Laws.Secondly,it discusses the theoretical basis on the subject of liability in road traffic accidents, and proposes the general standard of determing on the subject of liability.At last,it analyses the subject of liability in specific traffic accisdents.
