Research On Death Compensation

Death Compensation in our country has gone through a bumpy road in the process of evolution. From the Civil Law to Tort Law, there are huge number of legislation about Death Compensation, which involves in the traffic accident, the maritime accidents, medical accidents, national compensation etc. The legislation of Death Compensation has changed from time to time. Besides, there are many discrepancies among branch laws which involve Death Compensation. Meanwhile, The basic theory of Death Compensation differs from"Inherent Interest Damage"to"Expectation Interest Damage". There are many issues about the nature and caculation of Death Compensation. This article will introduce the different steps of the development of Death Compesation in our country. The writer would make some comments on the Death Compesation, so as to give legislative suggestions herein.This Paper includes five parts. The first part will introduce the six steps of the development of Death Compensation. The second part will analyze the basic theory of Death Compensation and explain its advantages and defects. The third part criticizes the concept of Death Compensation and explain why the dispute on the nature of Death Compensation is meaningless. The forth part will discuss the calculation method of Death Compensation. The last part summarizes the problems of Death Compensation in our country on macroscopic view and further suggest adopting "succession socialist" to build our death compensation system.
