Marine cargo insurance, as a means of economic compensation, can effectively protect the safe transportation of goods. Once appears irreparable loss, the Applicant (or insured) can obtain the appropriate financial compensation by means of transferring the loss to the Insurer. This method not only can avoid the loss expansion, but also maintain the relationship of cooperation and business reputation, which plays an important part in the international trade. In addition, Shanghai will be built into a major international financial center and shipping hub by 2020. Against this backdrop, marine insurance, as a financial service connecting international financial center and shipping hub, has been already put on agenda. Throughout the development of marine insurance, as for the Applicant or the Insured (the dissertation makes them into one party to study due to the both parties existing the similar interests in most cases), how to select appropriate risks plays an important manifestation in marine insurance. However, there is no discussion about it in the academic field currently. Given the marine insurance practice in China, the dissertation takes the insurance clauses of People's Insurance Company of China for example, and try to study legal risks of selecting issues and prevention from the perspective of the Applicant (or Insured), through the classification lists and empirical analysis method.
