Theoretical Study Of Chinese White-collar Crime

"White Collar Crime", which was proposed and used by Edwin Sutherland (American criminologist). He defines white collar crime as"people have respects and high social status whose criminal behavior in vocational activities". Since then,"White Collar Crime"became a terminology for criminology which lead to wide study in the academic area.This dissertation is divided for 3 chapters:The first chapter mainly defines the concepts of white collar and white collar crime."White Collar"is the particular multitude who has high reputation and education, gives priority to brainwork, makes life by using knowledge and skills, and works in management or professional job area. In our country,"white collar crime"can be defined as individual or enterprise that has high educational diathesis, social status and certain economic strength, makes income by brainwork, in order to make illegal benefits whose criminal behavior by using the power and convenience of job and non-manual work.The second chapter mainly introduces the category, characteristics of white collar crime and analyzes the reasons of white collar crime. Through the introduction of the white collar crime category by foreign and domestic savant, one summarized that the category of white collar crime can be economic white collar crime, malpractice white collar crime, disorderly social management white collar crime, bribery and corruption white collar crime, conversion of property white collar crime, jura personarum violation white collar crime. Through the introduction of the white collar crime characteristics by foreign savant, one summarized the points of the white collar crime in our country: the intimacy between social culture and social context, the concealment of crime behavior, the diversity of crime behavior, the misusage of the job,the intelligence of the crime, the organizational crime behavior and more worse social harm. To analyze the reasons from individual side and social side of the white collar crime by the three classic white collar crime reasons from the introduction, analyses of the foreign studies.The third chapter mainly indicates the prevention of white collar crime in our country. To enhance the control of the legal side through establishing perfect nomothetic strategy and judicial strategy. To enhance the control of the social side through redefining white collar culture, improving the management structure and internal control, deepen politics and economic innovation. To enhance the control of individual side through paying more attention of education and controlling of individual economics.
