The Study On Originality Of Integrated Circuits Layout Design

China's "Regulations on Protection of Integrated Circuits Layout Design" has been promulgated and implemented for nearly a decade, but the research on the originality of the integrated circuit layout design is still very poor. This situation has severely hampered the "Regulations" to play its effect, and also affected our efforts on the legal protection of integrated circuits. As a primary element of Legal protection of integrated circuit design, the definition of originality plays a vital role in the registration of integrated circuit layout design and infringement.Based on the characteristics of integrated circuit layout design, the author compares with the relevant provisions of IC layout design and the other objects of intellectual property in this paper. By making research of the principles and methods of defining the originality of IC design, the author hopes to provide specific, workable suggests to the technicians in the IC industry and the law officer.This article is divided into five chapters, referring to the characteristics of integrated circuit design, the definition of thought and expression, originality elements and identification methods of the IC layout design, and the problems found in the judicial practice and proposal of improvement.
