The Judicial Cognizance Of Amount Of Crime

In the criminal legislation of China,it holds that the offense relating to qualitative and quantitative combination. As the quantitative elements of crime constitution ,the amount is often prescribed in articles sections of the criminal law.Amount plays an important role for correctly conviction and sentencing.This paper mainly discusses the judicial cognizance of amount, including the accumulation of amount and the relationship between attempt, error of cognition and amount, in order to correctly conviction and sentencing.This paper mainly consists of four parts,the first part emphatically expounds crime amount of the concept, classification and function. The second part is crime amount of calculation principle,and the calculation method, this part mainly aimed at common crime amount calculation method,basically including the amount of calculation in theft,drug offences and crime of misappropriating public fund.The third part is the accumulation of amount,basically theoretical basis of amount accumulation regarding repeatedly behavior and the accumulation method in repeatedly behavior and alternative charge.The fourth part discusses the relationship between amount and attempt, error of cognition. and proposed own views in determining amount in this two circumstances.
