| The revised Criminal Procedure provides a new supervision function of the Procuratorate, that is, this function is a powerful weapon to lessen the situation that are not justice and unfair such as cases not strictly filed, crimes not punished, fine instead of punishment and so on. However, with the further implementation of this function, flaws and shortcomings of this function are increasingly prominent. The supervision intensity and effectiveness is difficult to hit the target value. The range of stipulated object of criminal case supervision in legislation is too narrow, the mode single, lack of effective means of constraints, and the program is not perfect; In judicial practice, the sources of case is little, monitoring space is limited, the current institution can not match up to its function. Therefore, we need to perfect the criminal case supervision mechanism.Some common problems such as the object of this mechanism, the range, the institutions and the specific implementation of it and several problems often encountered were discussed in this article, some suggestions such as how to perfect the mechanism were proposed. In legislation, we should expand the range of the objects, and should stipulate some effectiveness and feasible punishment and perfect the supervision procedures; In judicial practice, we should strengthen public education to mobilize all forces that can be mobilized to expand the source of supervision case and establish some special supervision departments to ensure that the cases be solved. To perfect the criminal case supervision mechanism is beneficial for the Procuratorate to fully play its role so that it can maintain the dignity of law effectively, punish crimes strongly and achieve fairness and justice better. |
