Prauratorial Organ Of Criminal Trial Supervision System Predicament And Consummation Countermeasure

The procuratorial organs were settled as legal supervision organs in the constitution of China. Currently, it can be found from judicial practice that the procuratorial organs are facing many difficulties on criminal trial supervision system. For one thing, there do exists certain deficiency in the system itself, such as the unreasonable time of supervision which made the effectiveness of supervision can hardly at work; the ambiguity of specific made supervision turned to formalism, many of these problems seemed to be details only, but they affected the result whether the criminal trial surveillance system could play its proper role indeed. For the other, the blankness of the law regulation also made the smooth development of the system to be difficult. Theoretically, national force is behind it, but when it comes to the concrete operation details, the corresponding provisions are lacking badly which caused the embarrassment for the prosecutors. In judicial practice, there may be no law to follow and in turn the law enforcement could not meet the situation, the trial surveillance work was heavily influenced by these problems. It can be said, how to improve the prauratorial organ criminal trial surveillance system better has become a top priority. This paper analyzed the content of the criminal trial supervision system, examined the prauratorial organ situation of criminal trial supervision work , aimed at some problems which were existing in the operation of this system, summarized the root problems and some feasible solutions which to strengthen the criminal trial supervision system was also put forward; And on this basis, some innovative ideas which can be used to further strengthen the procuratorial organs criminal trial supervision work were put forward. It is hope that all the above ideas can contribute to the better improvement of the prauratorial organ criminal trial supervision system of China.
