The Thinking Of Liability Legislation About Damage Caused By Raised Animals In Our Country

It is an important and essential problem that protecting the personal rights of natural persons in civil law countries of the world, which is also most likely to dispute ,and is most likely to suffer in the real life. With the individual keeping large pet trending intensifily in China in the recent years, both in urban and rural areas, either in individual family or in public places like the zoos, the animals cause damages frequently and bring people's life many unnecessary disputes and inconvenience. However, in our legislation, with specific articles of the accountability mechanisms are not sound enough to be pursued, the tort law system is established relatively for a short time so that many specific provisions of the law and its scope are not clearly defined. Tailed implementation of plans and the role and functions are not yet fully understood. Many specific legal issues are to be resolved. I think deeply of the phenomena of legal and explore ways to solve the problem, and try to promote legislation to make our country continue to improve relevant legislations on animals.This article starts discussion with describing and analyzing the general cases, which leads to this main idea that raising animals causes damage and the problem of inadequate legislation, and then, in the dissection of the animals cause damage on some of the responsibility and the basis of the basic legal issues to analyze methods listed on the real life. Some specific and difficult legal disputes were analyzed and the existence of our country in this regard was inadequate. Then combing with relevant foreign legislation, I have been investigating to prepare for reference purposes, and the damage caused by animals to our country the responsibility of the legislative status of the investigation. As for relevant legislation for the problems, this paper based on the conditions on the basis of the improvement makes some specific proposals and put forward some ideas more in line with China's national conditions, to the improvement of breeding animals cause damage liability benefit related legislation.
