The Research On The System Of Test Case

The test case is an important replaceable way to deal with the group litigation. It can resolve group disputes more efficiently through selecting a typical case as a model which has model effect on other similar cases. The representative litigation in China does not play its role properly, while some practices in our civil procedures are more similar to test case and some rudimental cases have emerged. In order to solve problems of group litigation in China, this paper analyzed the functions of test case and its values, expounded and proved the approach of model effect, probed into the feasibility of transplant of test case, and looked forward to the establishment of a diversified resolution of group disputes in China.
