Research On Legal Problems Of The Collective Economy Organization Member Right

The member right of the Rural Collective Economic Organization is a kind of member right. It both has the property of the social security, and that of citizens'private right. The Member right of the Rural Collective Economic Organization is the right which is closely attached to the land. It includes property rights and identity rights. The property rights are the rights that the members can take use of the public property which is based on the collective land. And the identity rights are the rights that the members have to take part in the management of the collective affairs. So the member right of the Rural Collective Economic Organization is a comprehensive right.The main property right is taking use of the collective land, like the land contract right and the home land use right. They provide the places to live and living conditions for the farmers. So this is an important way of social security in the country. But in China there are so many defects in our legislation of the member right of the Rural Collective Economic Organization, that it's hard to protect it. This paper tries to discuss these defects in legislation to consummate legal system of the member right of the Rural Collective Economic Organization.This paper points five parts. The first part outlines the basic theories of the member right of Collective Economy Organization and argue that the member right of the member right of Collective Economy Organization is a kind of member right. The second part of the paper argues the defects of the law in this problem. And from the third part to the fifth part of the paper demonstrate respectively every defect in the law and try to find the solution of these problems. Determination standars shall consider census register and members'rights and obligations. The voting of the member right of the Rural Collective Economic Organization shall include admitting new members, deciding collective affairs, voting, recalling and supervising, and the voting proceduces needs to be perfected, too. The right of formation is need to be perfected to protect member right. It also needs to protect the member rights some special subjects, such as the college student, the compulsory serviceman and so on.
