Now China is in course of a special period during which traffic accidents happen very frequently. The severe status will certainly cause the defensive action of the society, but now the other control measures are not so effective,it is necessary to design and perfect the network of criminal sanction. This is positive and practical significance to the protection of human rights and maintains public safety.In the criminal law of China, only the actions that caused very sever accidents are regarded as crimes,the control scopes and the criminal sanctions don't match reasonably. This article analyzes the reason why road traffic accidents often occur in our country, which based on current legislation and judicial practice in China.After introduced and evaluated the foreign legislations the author roundly analyzes and reviews the current problems of traffic crimes and administrative law in china. Based on the basic spirit of the criminal law, the author proposed the basic principles that reconstruction criminal justice system should follow.Then the author puts forward some constructive advices about charges classification and the controlling and punishing scope of traffic crimes.In this article, the author stress the importance of secondary classification about the charges in the crime against public security in order to highlight the importance of the offense against traffic security,and raise the improvement of the traffic accident crime of conviction standards.The author also put forward some reasonable suggestions on the dangerous driving.Besides the author suggest adding the traffic hit and run offense, the dangerous driving charge, and the crime of abuse and dereliction of traffic police.In the end the author have overall construction of the order of the criminal code traffic control system with the intention of remedying the legislation about traffic crime in china.
