A Study On The Retroactive Effect Of Rescinding Contract

The rescission of the contract is a very important problem of the contract law, and the problem on the retroactive effect of rescinding contract is an important part of the rescission of the contract. The blankness and inconsistency of the legislation of our country lead to many disputes on the retroactive effect of rescinding contract, it is necessary to study them.This article tries to discover the deficiency of theory and legislation in our country through analyzing comparatively the theory of the two law families and prejudications. On the basis of these analysis, this article wants to bring forward ideas about rebuilding the system of the rescission of the contract in our country.
