Study On Several Legal Issues In B2C Service Providers Of Electronic Trading Platform

B2C network shopping transaction as a kind of new shopping pattern, the B2C network shopping transaction is developing very fast in China .In recent years, the number of Internet shopping in continuously increased, the number of trade continues to expand. However, China's adjustment of shopping transaction network of B2C legislation electronic trading platforms service provider of law is not perfect. For example, legal status of service providers ambiguous, unclear civil liability and imperfect system regulatory. In order to promote the healthy development of the network shopping transaction, this paper studied those questions and puts forward some solutions. First of all , I research the concepts of B2C electronic trading platform service provider, development history, classification and business , the feature basic theory of relevant legal issues lays the foundation for further research of service provider; Secondly, the theory about legal status of the service provider are analysis and evaluated, and proposed legislation suggestions to service provider's rights and commitment; Thirdly, the legal liability of service providers, imputation principle of service providers and compensation for damages are researchecd. Some suggestions about solving the dispute in the network shopping transaction and bearing the liability are raised; Finally , the difficulties and reason of legal supervision for service provider are analyzed,and some ideas are put forward to perfect supervision mechanism of service providers .
