Immunity of witness is called stain witness too. Immunity refers to a country, in order to get some important proves or find out the serious guilty of the main crimes , makes promise to the crimes whose guilty is not as serious as others in the same case or in other different cases that if they give up their right to refuse proof but offer some key proves would not be investigated any more . Immunity doesn't mean to remit witness'all the guilty responsibility, the witness doesn't have right to request to remit his guilty to his proof that has nothing to do with the case .To crack down crime and guarantee human rights are two basic aims in a criminal suit process. But they often produces contradiction in practice. In order to find a balance point in cracking down crime effectively and guaranteeing human rights ,many countries and regions set up the Immunity of witness system .It has become an important system in some foreign countries and its unique way play an important part in cracking down crime and guaranteeing human rights , but our country still has not made any law stipulation to it although has made some useful attempt in judicial administration practice .It is necessary to introduce the immunity witness. This article analyses the immunity witness and then explores the construct of the immunity witness system in our country .
