On The Protection System Of The Reliance Inerest

The theory on the protection of the reliance interest has been studied for many years at abroad and has born plentiful and substantial results .Compared with other countries'theories of the reliance interest, the theory has not been deeply studied in China. With the development of market-oriented economy,the system of the contract and the demand of the theory of the bona fide doctrine and protection of the interest of parties, the theory on the protection of the reliance interest has already played a very important role in the aspect of protecting the interest of the contract. This research, mainly utilizing such means as historical analysis ,comparative analysis and value analysis etc., started with the concept of reliance interest and origin and development of the protection of the reliance interest, analyzes the current domestic status and problems in terms of protection of reliance interest, and also makes some suggestions to improve the system of protection reliance interest in China.The scheme of the discussion is divided into four chapters as follows:In chapter one, it mainly make a research on the theory of the protection of the reliance interest and the relevant definition in the contract.In chapter two, it is to make a study in the history and the development of the theory on the protection of the reliance interest, and points out connection and difference in two major legal systems, and then emphasizes the dissertation on the protection of the reliance interest, including the application ,components of damage recovery, the scope and methods of recovery.In chapter three , It talks about reliance interest protection system in modern contract law, including legal provisions and problems on reliance interest protection system in China.In chapter four, it offers some improvement suggestions on system of protection of reliance interest in China Contract Law based on the practice of legislation and justice.
