Theoretically, the right of sentencing suggestion is generally belonged to the range of public prosecution right in various countries. Practically, the right of sentencing suggestion not only enrich the content of public prosecution right ,but also benefit public prosecute institution's locating itself well and exerting itself on criminal justice. The system of sentencing suggestion began to be implemented at the basic ten years ago, while the supreme prosecute institution propel the the system of sentencing suggestion four years ago, As a result, the number of cases which adapt to sentencing suggestion is increasing, and the range is broader, from the preliminary sentencing suggestion to the cases of the simple procedure to the normal procedure which is heard simply, cases of juvenile delinquency and no objection to the fact and imputation. There are no definite regulation on the right of sentencing suggestion and unique executive procedure .therefore , this dissertation further demonstrates the function of sentencing suggestion in the hope of benefit to a united and formal execution of the sentencing suggestion.
