Study On Reconstruction Of The Relationship Between Prosecutors And Police Prior To The Criminal Procedure

According to the famous German scholar,Professor Herman's academic point of view that we can not become involved in the law confirmism .He thinks that criminal proceedings in any aspects in practice are consistent with the provisions of the law .We should consider the criminal proceedings as a kind of living organism,which is like any other functioning system in society always experiencing the changes and it is often changing itself deviated from the law sets.Thus,I wrote this paper using the prosecutor organ on pretrial proceedings as the leading role of the whole case to create a new model of pretrial prosecutors and police procedure in order to better build a strong monitoring mechanism to safeguard the implementation of the law.In this way, the People's Procuratorate can play better monitoring function. As culture of different countries constantly blend and crash,the advanced ideology and culture are always worthy of learning by any other country.We should also learn from the advanced model of the foreign countries for the modeling of the integrity as well as the rank difference of the relationship between procecutors and police prior to the trial proceedings ,perfecting the functions of the People's Prosecution's legal supervision. However, Pretrial system reform can't be made in one night,and it should be fitful for the whole judicial system .If it advances or lags behind the present judicial system,it will not produce substantial meaning regardless of the pretrial proceeding system changes.
