Case Studies Of Technological Protection Measures For Computer Software Copyright

Technological protection measures as an effective means of copyright protection, are increasingly being used by the computer software copyright holders. However, take technological protection measures into copyright law system has also brought many problems, technical protection measures likely to be abused by the copyright owner, it may harm the public interest, undermine the balance of interests on the copyright law. How to improve the technical protection measures of the legislative and judicial practice, is an extremely important issue. Based on the analysis of several typical cases, discussed the concept of technological protection measures and the contents of the protected conditions, combined with the trial of other issues arose in practice, this article summarized some general character and individuality of technical protection measures of computer software copyright cases, and wish to be subsequent for legislation and judicial practice in the future.This article is divided into three parts:The first section discusses the concept of technological protection measures, protected conditions, and the impact to the copyright protection.The second part analyzes three typical cases of technological protection measures for computer software copyright in China in recent years, through the cases to explore issues related to technological protection measures.The third part is a summary of the case analysis. It summarized the general character and individuality of each case, and analysis related problems of technical protection measures of the system from the perspective of the legislative and judicial practice. It also put forward its own proposals.
