The Balance Between Public Interest And Personal Interest In Housing Demolition

Currently, with the rapid development of city, housing demolition has become a hot issue. There are serious controversies and disputes come out. The essence of house demolition is a national public power intervention in property rights, and the public interest is the only legal basis, should always run through the house demolition. January 21, 2011,"the houses on the state-owned land levy and compensate ordinance"promulgated, the Bill for the first time making specific definitions of public interests, and trying to protect both public interest and personal interest, and solve the problems which causing by housing demolition. This paper reviews the present status of house demolition, and analysis in the interest relationship, clear the essence of disputes is the interest disputes, and also research the balance of interests and personal interests in developed countries, try to explore a suitable institution for interest balance in China to make the public interests and personal interests harmonious coexistence.
