The words such as humanism, humanitarianism are now familiar to the people.However as a kind of system virtues, humanism is often neglect. It's be considered as a part of procedural justice. In fact, procedural humanism is totally defferent from that. They are both parts of the inner process values . Whereas justice practice has launch a campaign of humanism, the author choose the theme as dissertation of L.L.M., which is also the first study in China.The dissertation consists of three parts besides an preface and a conclusion. In the first one, five reasons has been given in the theoretical and practical aspects. It is proclaimed in the second part that the meaning of the humanism can be divided intotwo parts. Then it delineates minutely the research done by Becearia, Mashaw, Summers, Chen Ruihua, Suo Zhengjie and the relations among proceduralhumanism, procedural justice and the due process,the relation between proceduralhumanism and human right. It's proclaimed in the third part the embodiments and drawbacks in the criminal procedural law and practice in China. In the end,the author appeal more and more people attach importance to humanism in the criminal procedure.
