With　the　E-commerce　and　E-government's　growing,　the　application　of　electronic　data　has　developed;　Electronic　Evidence　has　played　an　important　role　in　our　society.　At　the　same　time,　Computer　crime,　network　crime　and　e-commerce　disputes　have　appeared.　But　the　digital　and　legal　character　of　Electronic　Evidence　has　caused　some　disputes,the　law　cannot　settle　the　problems　timely。　The　whole　article　is　divided　into　six　sections.　In　the　first　section,　the　essay　investigates　the　concept,　character　and　classification　of　the　Electronic　Evidence。　The　second　section　analyses　various　kinds　of　Legal　status　theories　of　electronic　evidence,　and　put　forward　that　we　should　change　the　old　idea　of　people's　firstly.　The　thesis　describes　the　independent　character　of　the　electronic　evidence　in　three　ways　that　is　the　electronic　evidence　is　different　from　the　characteristic　of　the　traditional　evidence,　the　demand　of　the　social　development　and　the　consideration　of　the　world　legislation。　　The　third　section　discusses　the　electronic　signature　of　our　country　and　the　electronic　evidence。　The　fourth　section　details　the　relativity,admissibility　of　Electronic　Evidence。　Firstly,　it　treats　the　relativity　and　Objectivity　of　Electronic　Evidence。Then　the　Electronic　Evidence　should　be　collected　by　the　legal　personnel　according　to　the　due　process.　It　also　should　have　legal　form　and　source。　The　fifth　section　treats　the　evidence　disclosure　of　Electronic　Evidence　and　the　balance　between　the　application　of　Electronic　Evidence　and　the　privacy　of　people。　The　sixth　section　investigates　the　different　legislations　of　electronic　evidence　with　the　vision　of　comparative　law　and　proposes　the　legislation　which　sets　up　the　legislations　of　electronic　evidence　of　our　country。　The　end　of　the　article　is　a　summary;　the　author　shows　the　importance　of　the　legal　analysis　of　electronic　evidence。...
