"Agreement on Trade-Related Aspects of Intellectual Property Rights", called the TRIPS Agreement, compoundly enables the intellectual property rights, the cargo trade, the service trade to become three main subjects over which the World Trade Organization has jurisdiction. Regarding China, one of the WTO members and also signatory state of the TRIPS, the TRIPS is one of the most important statutes that must be observed. TRIPS itself is not a uniform law, but a set of the lowest standards that must be observed by various member nations to protect the intellectual property rights and must be implemented by the relevant laws and legal procedures. The requirements in the intellectual property rights by the TRIPS (namely the TRIPS standard) inevitably have similarities and conflicts with the intellectual property rights protection standards already implemented in the signatory states. This article, taking the intellectual property rights property requirements (namely the so called TRIPS standards) as frame, analyzes the TRIPS standards, as well as consistency, conflicts and cod counteractions between the TRIPS standards and the intellectual property rights protection standards in the representative signatory states. Base on the research results above, the author puts forward several proposals in China's intellectual property rights protection mechanism.
