Expert Witness In Civil Procedure

The Civil Procedure aims to resolve disputes. The evidence is the key factor which helps the Judge make reasonable and correct judgment. With the human being knowing more and more knowledge in widespread fields, many information has exceeded the range of Judge's brain. It's inevitable that the expert participate in the Civil Procedure, and the participation has been more and more deeper. The present Civil Procedure system in mainland China doesn't have enough perspective concerning the expert attending and thereby promoting the procedure. The article attempts to analyze and evaluate the theory foundation and factual operation of the expert witness, and further to discuss how to break through the old system and to establish the expert witness system. The system we want to establish will integrate the Judicial and the Professional Scientific resource successfully, make the Judge get more correct information, strengthen the procedure parties participation ability, and finally make the judgment more reasonable and acceptable.
