This paper originally comes from my thinking on some " special civil infringement cases " in recent years. Cases having some kind of public factors were often settled by the vessel outside the institution, which makes me think of the system itself. The starting point of the paper is to find out what kind of tort liability is the country responsible for, because the standard of state compensation decides what kind of compensation liability can be solved by the in-institution vessel. However, to e xplain one concept with another concept doesn't help. After comparing the national compensation standards between China and some western countries, the writer finds that what cause the standard differences of compensation liability between these countries are the different relations between the society and the country behind the institution The specific institution problem cannot be resolved by regarding providing Communal Facilities as a duty of the state, because the problem needs to be resolved is how to distribute the liability. I analyze the resolution under the current legal system and oppugn the subject qualification of the civil tort liability of the administration organ. Chapter One compares the compensation standards between our country and some other countries, and finds that what causes standard difference of compensation liability is the different relation between the society and the country. Chapter Two surmise up the historical development of the tort liability of the communal facilities, and explores the methods of solving compensation liability of communal facilities. Chapter Three explains several theories of Liability Distribution of Relevant Persons. It probe into the way of distributing liability in the trend of " public affair private to manage "emphatically.
