Research On Statute Conflicts Related To The Three Gorge Resettlement

The Three Gorges Project that attracts worldwide attention is causing about 12,000,000 emigrated people in Three Gorges Reservoir Area, which is on the top of the world emigration for hydraulic engineering. So foreign irrigationists call it "world problem".The key point leading to the Three Gorges Project failure or success is migration. The migration resettlement will be referred to the key for the success of the Three Gorges Project and to the safe & stability of our country. In order to help the Three Gorge resettlement go on smoothly, "Emigration Rules in The Three Gorges Project" was firstly published to regulate it in our country in 1993. This is the first statute for the emigration in Three Gorges Reservoir Area in our history. By practice for ten years, its malpractice has been obvious. In 2001, the new "Emigration Rules in The Three Gorges Project" is been published. But these two emigration rules have some conflicts with our using laws, statutes, and policy. Some scholars have gone deep into research with them, but they attached importance to rules published in 1993. And little problems in 2001 have been done. Then, the paper studies new rules published in 2001. By analyzing conflicts, we propose some methods to solve conflicts among rules. We hope the emigration's government can exercise administration according to law, emigrate according to law, and guarantee emigrants in Three-gorges area legal rights & interests, and ensure the Three Gorges Project smooth.
