On Money Laundering

Money laundering is a new accusation in the last decades, which not only disturbs the order of national financial management, but also corrupts the staff in various government functional departments. It is the hidden danger to influence the social stability, causes serious damages to a country's social order and threatens the stability and development of international economy. It has become harmful in international society. In order to contain the development of the crime, international organization and our government have formulated related laws and regulations. In our country, there are various different views existing between criminal law scholars and judicial workers. This dissertation intends to probe into the issue in great detail on the basis of our country's criminal law as well as the comparison of legislation home and abroad.In the dissertation, firstly, an introduction to the definition of money laundering and historical review are made. The harmfulness of the crime is analyzed. The establishment of criminal law against the crime in foreign countries and country is looked back briefly. Theoretical research on the constitution and the recognition of the crime is made. And the emphasis is laid on the analysis of the issues in terms of the criminal objects, target of the crime and scope of crime source. Based on the analysis, ideals are put forward on these questions such as non-art of crime, scope of the criminal subject and so on, which have been debated.This dissertation, in the second part, analyzes the current state of legislation abroad and introduces the legislation state in the countries practicing the Common Law System and the Civil Law System. The comparison of legislation system between China and foreign countries is made.
