A Discussion On Several Problems About The Crime Of Robbery

Robbery , a frequently-occuring Crime in modern society, has always been severely hit by government because this kind of crime not only invades people' s property right but also threatens personal safety. Now , there are 3 codes in Chinese criminal law:No. 263, No. 267 and No. 269, but it is a pity that these codes can not convey the contents and specifications vividly due to the simplicity of laws. That is why the discussion about robbery crime is never stopped. As a judicial cadre at the basic level , I try to explain the robbery crime in system according to the questions met in my working experience .The contents in my article will include definion of robbery crime , robbery type , object and target, accomplice and crime patterns. Why is Robbery crime put the first place in property invasion crimes ?This is decided by the dual nature of the object, namely property right and personal right. Property right, the main object, is the characteristics which differ from other crimes. This is the key topic discussed at the very beginning of my article . In my opinion, with the development of market economy, property interest , fictitious property , etc will be the action objects of robbery crime. I am for the viewpoint that property occupation, must be the only standard to differentiate accomplished offense and attempted crime. Serious results may be regarded as an attempted robbery crime. .If no serious result happens, it is still an attempted robbery crime.
