On Modality Of Embezzlement

There have been currently a very serious position to prevent embezzlement in china. Crime of embezzlement,is not only infringe disinterestedness of official, but also endanger stability of society and politics. To discern the character or nature of embezzlement is key to destroy and prevent the crime, and to research the character or nature of embezzlement should be enhanced rapidly. Here, from the viewpoint of modality of embezzlement,We studied the character of embezzlement. In this thesis we described three modalities of co-crime, the suspended situation and the form of quantity of crime of embezzlement. At the first section, a novel principle of conviction by identity was shown in the thesis, and the modality of co-crime of embezzlement was detailedly analyzed between identity and non-identity. At the seconced section, attempt was emphasized as part of the modality of the suspended situation of embezzlement, and some novel pointes are shown after analyzed some cases, at last section, we descrie various correlative modalities relating to modality of the form of quantity of crime, for example: the coupling of imagination, the overlapping of articles, recidivist, Continuing offense, transformation offense and implicated crime. Moreover, we also deeply analyzed and sudied relative statutes and judicature from the viewpoint of criminal law.
