| China is a big shipping country and has many ocean country. Since China has large sea area, she has not only rich ocean resources but also diverse ocean systems and many kinds of sea animals. With the developing of China's modern economy, marine environment has been effected Oil shipping is one of the main reasons for the pollution of the sea. China has became the second large oil input country in the world by 2003 .The risk of the oil pollution from ships is increasing . The law of the compensation for the oil pollution damage from ships is a very international and special one. This law has been effected by the tort law, environment law and maritime law. Because China's law system for oil damage compensation is not very clear, the judges may use different kinds of laws to make a judgment. The lack of the law system is not good for the prevention of marine pollution nor compensation for the victims. The oil owners need not to take the liability of the pollution is not fair too. So, it is very important to make a better law system.The main topics of this essay is about the law of damage liability and the compensation for oil pollution by ships. One is how to judge the liability and the other is how to compensate those who have suffered loss as a result of an oil spill from the ships. This essay analyzes china's oil pollution compensation system, the international oil pollution compensation system and some various countries' typical law systems. At last,put forward my suggestion for the way to accomplish the law of compensation for the oil pollution damage in china.
