Parties in carriage of goods by sea include carrier, actual carrier, shipper and consignee. Among the parties there are complicated legal relations consist of the relations of rights and duties engaged in contract and the relations of righs and duties stipulated by law. To determine the rights and duties of every parties, we should identify the parties first.identification is a difficult problem in the studies of maritime law for a long time. There are different rules of identifications of carrier and other parties even in different countries in which the Hague Rules apply. To simplify the identification, draflsmen of Hamburg Rules made great efforts and the effects were remarkable. But Hamburg Rules also brought some problems. This paper discusses the progress of Hamburg Rules, tries to analyze and solve the problems and attempts to set up the rules of identification in Chinese legal system.
