The oil pollution arising form collisions of the ships is a very important issue. But there is little study on this issue. There exists a hot debate as to who is the person directly liable for the oil pollution arising from collision of the ships. This paper mainly discusses the issue and supports the opinion that the owner of the vessels discharging oil should be directly liable for oil pollution damage.This paper analyses the person directly liable for oil pollution by researching means of comparative analysis on the international convention, other nations' law, Chinese law, such as 69CLC, 92CLC and OPA90. In further this paper explain that why the owner of the vessels discharging oil should be directly liable for oil pollution damage.This paper considers that the strict liability should apply in the field of oil pollution arising from collision of the ships.In final, this paper analysis the person directly liable for the oil pollution arising from collision of the ships in China and propose the suggestion of the law system of the oil pollution damage arising from collision of the ships.
