This text explains the basic meaning, characteristic, and the advantage of the OEM management. Also contrasts the development of OEM in the developed countries with that in the developing countries, to announce the necessity of concerning the legislative of OEM. Moreover, introduces the related international conventions in turn, points out the current condition of the international legislative.From the second chapter, in the most three sensitive respects, introducing and comparing the legislative condition of the developed countries and the developing countries, to unfold the existing problem.The fifth chapter is the most important chapter of this text. In this chapter, puts forward the related legislative suggestion to the problem existing in 《Rules of Original》 , 《Trademark Law》 , 《Contract Law》 . The writer also suggests that the government should establish Processing Trade Law as soon as possible, in order to guide and control the huge processing market in China. Among this law, we should make detailed provisions for each part of OEM, to promote the development of OEM in China as well as we can.
