A Study On International Factoring Law System

International factoring is a new payment technique, which plays an important role in international trade. This thesis researches the legal issues correlated to international factoring, and get the opinions and advices about legislative works and execution of law and factoring practice by the basic theories and means. There five parts in this thesis:Part A. Introduce the definition of factoring, the origin and evolution of factoring, types and procedures of factoring, the benefits of factoring and legal character of factoring.Part B. Introduce the basic parties of factoring, which include the supplier, the debtor, the export factor and the import factor, and legal relationships between them.Part C. Introduce factoring law in the international organization and some central countries, such as the United States, Britain, Germany and Factors Chain International(FCI).Part D. Introduce the development and problems of factoring in China.Part E. the keystone of the thesis. On the basic of that four parts the writer illuminates factoring law in our country and put forward the opinions and advances, such as: to establish relevant laws concerning factoring, to establish a perfect back-up credit system, to emphasize the training of professional personnel in the field of factoring.
