Strike-Hard drive, which means campaign to crack down relentlessly on various criminal activities in accordance with law, has been one of basic criminal policies closely relating to economic construction during the course of Reform and Opening-up within the territory of China.The writer deeply analyzed this policy from various angles such as the signification, arising reason and characteristics of Strike-Hard criminal policy, and especially analyzed the conflicts arising from this policy and the general plan of "Rule of Law", principal of "Statutory Prynciple of Crime and Penalty", human rights protection and fair judiciary, and analyzed the shortcoming between the policy and the expansion of the function of criminal punishment.Finally, the writer made conclusion. As the product of special period, Strike-Hard policy emphasized the absolutely chasing to effect and consequence of crime prevention and controlling and ignored the necessary concerns about human rights and fairness and also ignored restraint function of criminal law as the last bank. Companying with the close of criminal law net and the construction of Rule of Law in criminal law field, Strike-Hard policy would be replaced by the policy of "lighting the light and striking the strictness" and disappear from the social and history stage.
