On The Comparative Study Of The Deposit Insurance Legal Systems Of Foreign Countries And Their Enlightenment

Under the comprehensive guidance of the theories of economies and law science, the dissertation, adopting the research methods of historic analysis, comparative analysis, probes into the characteristics of the deposit insurance systems among the United States, the United Kingdom, German and Japan on the base of analyzing and comparing the historical backgrounds and essential contents of the deposit insurance systems of the four countries, and puts forward to the constructive suggestion of the deposit insurance system of China according to study of the reasons resulting in the problems of this system. This dissertation consists of four chapters.Chapter one defines the notions of the deposit insurance system, and concludes its necessity based on the theories and practice after brief introduction of its nature and classifications.Chapter two separately analyzes the historical backgrounds of the United States, the United Kingdom, German and Japan, and studies the essential contents of the systems among the four countries in the view of the legal relationship. The core of this chapter is the analysis of the legislative design and the pattern of each system.Chapter three explores and analyzes the reasons resulting in the problems, such as the problem of moral hazard, the problem of adverse selection and the problem of too big to fail, which the writer finds during the process of the characteristics analyzing and comparing, and points out the enlightenment to China.The last chapter -- Chapter four points out the legislative design of the deposit insurance system in China and concludes its necessity by means of the foreign practice in the four countries, after analyzing the present management of saving banks and the financial supervising in China and combining the actuality of resident' s deposit in China.
