Injury determining is the basic and central concept in anti-dumping law. Dumping acts having caused injury is the key requirement for which one government will impose anti-dumping measures, but injury determining depends on specific injury standards, so far, unfortunately, they are abstractly and vaguely stipulated in law documents of every country and Agreement on Implementation of Article VI of GATT 1994. In order to reasonably determine the injury in anti-dumping measures, it is badly necessary to further study the standards of injury determining.This thesis discusses extensively and deeply dumping injury determining standards by means of comparative—analysis on the bases of relative stipulation in Agreement on Implemention of Article VI of GATT 1994 and U.S., E.U., PRC. The contents involve like products, domestic industry, specific injury patterns, illustrated by actual cases. The author points out clearly the drawbacks of current standards and put forth the suggestions to improve and perfect China's anti-dumping laws.This thesis includes four parts.The first one survey injury determining standards in the world, simply summarizes its concepts and principles.The second one explicits legistations and practices of injury determining standards in the world, among which on Implemention of Article VI of GATT 1994, U.S., E.U., etc. are the key objects discussed. A retative typical case adjudicated by the DSB in WTO is analyzed here too.The third one deciphers legislations and practices of injury determining standards in China. It first expounds Chinese regulation and then analyzes Chinese practices through concrete cases.The last one evaluates current injury determining standards of dumping and gives suggestions how to perfect China's anti-dumping laws.
