The appearance of the Internet has made people's production and life tremendously convenient. It shakes the original legal protecting system violently and causes the readjustment and reallocation of rights and benefits. At present the new legal problems caused by that kind of new technique concentrates on the field of copyright infringement, so copyright protecting system improves constantly with the development of diffusing technique and method. The appearance of the Internet has changed the works' diffusing method, enhanced the difficulty of copyright protection, which makes the traditional theories face rigorous test and challenge. But the legislation falls behind the time obviously. The legislative delay causes the phenomenon that there is no law to observe for the judicial practical office, which is not good for encouraging creation, making science and literature prosperous and impedes thehealthy development of the new style of industry------the networkindustry. For that reason, how to protect the copyright on the Internet has become a current hot issue that the law theory circle and the judicial practical circle care about.
