The Research On The Law System Of The Copyright In The Internet

The internet has developed at a high speed and brought great influences to every part of the society in only twenty years in China since the international network project—Chinese Academic Network was started by Beijing Computer Technology Application Research Institution in 1986.In the aspect of law, the development of the internet technology has brought a great challenge to the traditional copyright system. In the internet environment, the protection to the copyright from the traditional system is very weak and it is very difficult for the copyrighters to exert their rights. Therefore the research of the copyright system in the internet is of great theoretical and practical importance. This article mainly includes four parts:The first chapter is about the challenges brought by the internet to the traditional copyright system. The number of writers that publish their writings publicly increases and the intention of some writers is disinterested. The form of recording the writings becomes digital in the internet, the writings are read by temporarily copied and spread in the internet at a high speed. The content of the copyright expands and the exertion of the right of spreading writings in the internet is limited by the level of technology and it becomes more and more important to protect the technical measure and the right management information and so on. All the above-mentioned need to be considered fully in the internet copyright system.The second chapter makes a comparative legislative research on the internet copyright systems of the U.S.A., the E.U. and the WIPO from the aspects of the reproduction right, the right of spreading writings in the internet, the technical measure, the right management information, the fair use and so on.The third chapter makes a case study on the BT download which is a typical method of spreading the writing in the internet. This chapter defines and makes a deep analysis of the deeds of the first uploader, the downloader of the document and the internet service supplier in the case.
