Research On Recidivism

In recent years, profound researches have been gradually done on the theory of criminal law as a whole, but relatively fewer on recidivism system. Compared with advanced legislation in foreign countries, regulations and theory of recidivism system in China lag behind the theoretical research and judicial practice of criminal law, due to no alteration within more than 20 years. The current condition in the research on recidivism system is not parallel to its status in measurement of punishment, hence the current recidivism system can not adapt to the changing criminal legislation and judicial practice. In view of this, an all-around analysis and discussion on key points of recidivism system will be done in the thesis, and proposals concerned will be put forward, in order to benefit the perfection of recidivism system in criminal law.
