Based on leasing and trade, financial Leasing has appeared as a new form of independent business transition to fulfill the needs of financing market after WWII. On one hand, it carries both of the characteristics of leasing and trading. On the other hand, it has broken through the operational system, which it usually generates. Moreover, it also appears with new legal characteristics.Financial leasing was introduced to China in the 1980' s of last century, people' s understanding towards it has constantly developed through business and social activities. Along with China joining the WTO and the continuing pace forward of globalization of economy, the study and research on international financial leasing have become more and more important. Comparing with other legal theories in the financial area, China has a late start and far from mature in this field. In many aspects, it is not yet unified. Since developed countries need to open and sell their products to international markets urgently, and developing countries need funds and advanced technology and equipments for improvements of production, therefore, international financial leasing is easy to be accepted worldly. Thus, the study on international financial leasing seems to be more meaningful and significant in a contemporary sense.In the meantime, 《Financial Leasing Law》 is being planned to become Law by National Delegation. The study on financial leasing and international financial leasing has more importantly significance and practical meaning.This article introduces the basics of international financial leasing, explains its concepts and characteristics, analyze its fundamental policies and treaty violation, then based on the usual theory of ConflictLaw probe into the issues of legal conflicts and application. Last, it introduces the history of the making of law on international financial leasing, and probes into issues of the making of law on financial leasing in China. The author has posed her own frame of making the international leasing law.
