Delivery Without Original Bill Of Lading And Carrier's Defences

Considering the fact that Delivery without Original Bill of lading(Delivery without B/L) happens frequently, and the disputes so caused are increasing, which mostly result in carrier to take the responsibilities, the article summarizes kinds of relationship between Delivery without B/L and trading disputes on the basis of illustrating many cases. In light of China Maritime Code(CMC),relevant international conventions and other countries'law, the article makes a detailed analysis on the risks and liabilities the carriers will face, including its nature and some issues under straight bill of lading etc, and also expounds some inconsistencies between the prevailing regulations and practice. Based on above,the article then puts emphasis on the defences which can be cited by carriers in future.In the end,the author makes some constructive legislation suggestions to release carrier's obligations of delivery against original B/L under some certain conditions.
