On The Enforcement Of Maritime Lien

As an old system, maritime law is taking an important role in promoting the development of shipping . Though in many shipping countries , the law about maritime lien is more and more perfect, in practice there are many problems in enforcing maritime lien .Therefore, the thesis makes a basic study of the enforcement of maritime lien .To lay the foundation for the further study, the thesis discusses the character, condition, time and model of the enforcement of maritime lien, thus it defines the content of the enforcement of maritime lien in theory. Then the thesis contrasts the difference of the two main law system in the world, especially the action in rem and its effect on the theory and practice of our maritime law .The most important thing for the enforcement of maritime lien is to specify its right subject, duty subject and its object. So the thesis lays the emphasis on them so as to be useful for the solution of the problems in practice. Finally, the thesis makes a research on the relationship of arrest of ship with the enforcement of maritime lien.Through the study of the above four aspects, I hope the thesis can benefit the practice.
