During the stage of investigation, criminal suspects are very passive, against the mighty right to sue them from the government. Moreover, due to the lack of relative mechanism to defend suspects human rights, suspects are in more difficult circumstances. In practice, suspects human rights are easily violated. This paper presents the necessity to guarantee suspects human rights by analyzing the development of both theory and practice about the protection of international human rights, procedural justice as well as the theory about subjects of criminal procedure. Then the present state of legislation and justice to protect suspects in China is analyzed. Meanwhile, tentative assumption to defend suspects human rights is given according to Chinese national conditions. Finally, the easy systematically discusses how to establish the mechanism of protecting suspects human rights from several aspects. They are to set up modern investigation principles, to reinforce the right of criminal procedure, to offer suspects the right of silence and to reform Chinese criminal compulsory measure etc.
