The procuratorate-police relationship delimitation as the important content in the penal procedure system should progress gradually with the reform pace of the adjudication mode of our country. However, the current penal procedure law stipulates that the People's Procuratorate and the Public Security Organs Should divide work and shoulder their respective responsibilities, cooperate with each other, and restrain each other when conducting penal procedures. Such a general principle of the procuratorate-police relationship is a loose detached mode: Since the investigation, accusation functions are regarded as respectively independent litigation periods, they have gradually become unadaptable to the development trend of the law of penal procedure, so many shortcomings have inevitably appeared in judicial practice, and the smooth conducting of penal procedure activities have been directly affected. Such a status quo urgently awaits innovation. Making reference to the procuratorate-police integration mode implemented in foreign countries and relevant regions is certain to offer illumination for the reform direction of our country's procuratorate-police relationship. And our country's legistration regulations, litigation theories and practical exploration provide the feasibility bases for establishing the closetype procuratorate-police relationship of the procuratorate directing the investigation. Reshaping the procuratorate-police relationship and promoting the court trial reform is of great significance for driving the progress of the entire litigation system. On such basis, propose the structural concepts for building the new-type procuratorate-police relationship, and design corresponding approaches for the relevant issues which might appear after implementing the procuratorate-police relationship reform.
