Discussing The Possibility Of Introducing Plea Bargaining

Plea Bargaining was originated in Anglo-American law system. Whether the system can be used or not in our country, it is often discussed in the circle of theoretic. Many scholars hold that Plea Bargaining is not fit for our country now and our country should not introduce this system. The author thinks that we can prove the possibility of introduction it, although there is the debate. This article testifies this problem in four parts. First part discusses Plea Bargaining in different forms from England and America to German and Italy. Second part analyzes the system in theory to testify that Plea Bargaining is not limited to one law system. Third part discusses that our country has the base on which we can establish our Plea Bargaining system. The last part discusses what disciplines we should take, how we establish the system and how to relieve the participants from unfair bargaining, if we introduce Plea Bargaining.
