| This thesis touches upon conception, characteristics and acquisition of trademark and domain name as well as advancement of domain name management system, analyzes legal nature of domain name and illustrates relationships between trademark and domain name, reasons for and types of right conflicts between them. On the basis of summing-up of practice of solving the right conflicts in WIPO, ICANN, U.S., Japan and China, and analysis of issues facing China in the course of settling the conflicts, this thesis makes a suggestion of principles, completion of current laws and regulations, and international cooperation so as to study the perfect modes to solve the right conflicts.
