Study On Unreal Joint And Several Liabilities

The unreal joint and several liabilities is a type of joint liabilities.lt means that some debtors have the same debt resulted from the different reasons occasionally,and if one of the debtors perform the debt totally or partly ,the orthers discharge their obligation totally or partly.After recalled the history,the thesis make a systematic study of the unreal joint and several liabilities from three aspects:1.why is it necessary?It argues that it is valuable because it can balance the benefits between the creditor and the debtors,among the debtors fairly. 2.What is it? There are two major problems: types and the relations among the orther similar rules. The types are analysed though 4 aspects: the reasons,whether there is the last debator, whether some debators have the defence profits ,whether each debt have the same amount .Then it differentiate the unreal joint and several liabilities from the shared-liability,the joint and several liabilities ,the vicarioul liability,etc.3.what the effect is it? Its effect includes external effect and internal effect.
