A Study Of The Government's Information Sharing And Exemption System

Government's Information Sharing Project has been promoted energetically in China. However, when confirming its positive significance, we should notice that government's information sharing is not unlimited. The western countries all accept that some parts of the government's information belong to exception documents, which not allowed to be published. Accordingly it has become the general rule in the countries all over the world that "publicity is the basic principle of government's information sharing to which un-publicity is an exception". The existence, amount and the degree of exception documents reflect from another side the extent and depth of government's information sharing. The research of exception documents of government's information sharing and the clarification of the content and the scope of exception documents will help to understand government's information sharing more roundly, supervise the powers of government and protect people's legal rights. It may well conclude that it is the precise definition of exception documents that complete the institutional system of government's information sharing. This article is based on the introduction of government's information sharing and exception documents and borrows the advanced legislation system of main western countries. Moreover, in accordance with the different values protected by different documents, this article comments on several typical exception documents. Finally it brings forward the proposals to how to perfect the exception documents of Chinese government's information sharing.
