Research On Civil Procedural Acts' Several Issues

A research on civil procedural acts is commenced from three aspects. First, by the study of the basic concept and the characteristics of civil procedural acts, we can know that the natural character of the civil procedural acts is that it forms the civil procedure. The civil procedural acts must include the acts of all procedure attendants and only occur in the procedure, which is very important to correctly master the bodies, contents and law effects of the civil procedural acts. Then, we can find it such characteristics as the procedure character, the meanings expression character and the rights' foundation character, with mixed nature of civil acts and procedural acts. The meanings expression character and the right's foundation character of the civil procedural acts are greatly different from the ones of civil law acts. Second, by an introduction to acts' law theory, law procedure theory and meanings expression theory, the foundation theory of civil procedural acts is set up and a strongly theory guidance is offered to the study of civil procedural acts from procedure to act itself moving rules. In the end, by the study of law states of civil procedural acts, we can know the contents and the effects of different law states of civil procedural acts, find the causes of defects of civil procedural acts, and establish methods of curing them.
